Rule 198. Return of Depositions (1973)
TEXT
Depositions may be returned to the court either by mail, or by a party interested in taking the same, or by any other person. If returned by mail, the clerk or justice taking them from the post office shall indorse on them that he received them from the post office, and sign his name thereto. If not sent by mail, the person delivering them into court shall make affidavit before the clerk or justice that he received them from the hands of the officer before whom they were taken, that they have not been out of his possession since, and that they have undergone no alteration. The party taking the deposition shall give prompt notice of its filing to all other parties.
Amended by order of Oct. 3, 1972, eff. Feb. 1, 1973: Sentence requiring party taking the deposition to give notice of its filing has been added.
